Abstract


This paper critically examines the legal and institutional framework on judicial autonomy in Nigeria. The paper employs the use of doctrinal legal research methodology and reviews statutes, case law, and journal articles that pertain to the independence and autonomy of the judiciary in Nigeria. The findings reveal that while the legal and institutional frameworks provide a strong normative foundation, enforcement is weak due to challenges such as persistent executive interference with the delivery of judgments, appointment bias, and inadequate funding of the judiciary. To address these challenges, the paper recommends the implementation of constitutional financial autonomy at the federal and state levels, the bolstering of the judiciary’s independence for unbiased adjudication, and the establishment of a regime of sanctions for non-compliance with constitutional provisions. The paper concludes that protecting judicial autonomy is essential for a healthy democracy, as it ensures that the judiciary can act independently and impartially. By safeguarding the independence of the courts, we uphold the rule of law, protect individual freedoms, and hold the government accountable.
