Abstract
The implementation of Sharia law in Bauchi State, Nigeria, in 2001, has sparked numerous agitations and discussions among minority faith members within the state, as well as human rights groups, lawyers, academics, and other interest groups. The primary concern has been the fear of domination and encroachment upon their fundamental rights as citizens. This concern stems from the fact that the implementation of Sharia law is binding throughout the state and applies to all persons. More than two decades have passed since the implementation, yet these agitations persist, manifesting in various forums. This research examines the Sharia legal framework in Bauchi State and its relationship with religion. It provides an in-depth analysis of the state’s laws and policies on religious matters, focusing on the intersection of Sharia law and secular law. The paper’s primary finding is that the current legal framework in Bauchi State recognizes and defines the rights of minority groups. However, despite this recognition, existing tensions and fears have yet to be fully alleviated. This research adopts a doctrinal method to comprehensively investigate the application and implementation of the legal framework. This involves analyzing primary sources, including legislation, regulations, and policies, as well as secondary sources such as books, journals, and articles. The paper recommends establishing a framework to engage members of different faiths in inter-faith dialogue, promote public enlightenment and awareness campaigns, and provide a platform to address concerns and issues decisively.
